Employers who are suspicious and mistrustful have the capability to monitor employees overtly or covertly with video surveillance. Generally, there is no bar to an employer maintaining video surveillance of workers. For proper guidance or information, we suggest that you talk to your legal advisor or read this publication entitled Employee surveillance: a new age in hi-tech spying on www.bellgully.com/resources/resource.00591.asp Any company or person involved in installing and operating security surveillance systems is required by law to hold a current licence or certificate- Private Investigators and Security Guards Act 1974. Nevertheless, the licence or certificate does not confer on the holder any more power or authority than that of an ordinary private citizen. The Ministry of Justice has published a discussion paper on this Act and it provides useful background information. http://justice.govt.nz/publications/ Go to Legislation and you will see Private Investigators and Security Guards on the main list. |
